Phillip has a wide background in civil disputes of all types, with particular experience in construction, business and employment litigation. Phillip has had numerous jury and bench trials in state and federal court, arbitrations and mediations. He is also outside general counsel to a number of businesses.

Phillip represents virtually all sectors of the construction industry: large and small general contractors, subcontractors, suppliers, design professionals and property owners. Typical matters include commercial payment disputes, construction defects and delay/impact claims and conflict avoidance through contract negotiations and early dispute resolution.

His employment practice involves the representation of both employers and employees, regarding terms and conditions of employment, wrongful termination, sexual harassment and other prohibited types of conduct. Phillip regularly counsels employers in ways to avoid employment disputes. He also represents employees who have been seriously aggrieved. In addition to considerable jury trial experience in this area he reviews and revises employment contracts.

Phillip's business litigation experience is generally centered around payment and performance disputes and regularly encourages his clients and assists them in appropriate contract negotiations and documentation.

Phillip is respected for getting to the bottom line of a dispute without engaging in unnecessary, expensive and time-consuming litigation activities. Because many of his clients are public entities and small and medium-sized businesses, this approach is appreciated and well received.

Education and Professional Activities

Phillip obtained his BA in 1975 from Beloit College and his JD in 1978 from Northern Illinois University, College of Law. He is admitted to practice in both California and Illinois. He is a member of the Public Agency Risk Managers Association and the Marin County Bar Association. Prior to relocating the main office to San Rafael in 2000, he practiced law in downtown San Francisco for approximately 20 years.

Expertise

Robert has a wide background in civil disputes of all types, with particular focus in employment litigation. He is also experienced in construction, real estate and business litigation. Robert has had numerous jury and bench trials in state and federal court, arbitrations and mediations. He is also outside general counsel to a number of businesses, providing advice regarding employment issues, business formation and payment disputes.

Robert's employment law practice primarily focuses on protecting employees' rights, from laborers to executives, physicians, professors, teachers and sales professionals. He also counsels a number of businesses to ensure employment compliance with all state and federal laws and methods to avoid employment disputes. This includes presenting legally mandated sexual harassment training for management level personnel.

In March 1999, Robert and his brother obtained what was reported to be the largest individual verdict at the time against a public entity for employment discrimination when a San Francisco jury returned a verdict of $2.75 million in favor of Dr. Howard McNier (McNier v. San Francsico State University, San Francisco County Superior Court No. 986713). Dr. McNier was denied a promotion and retaliated against when he complained about unlawful discrimination that occurred on campus.

Typical employment matters handled on behalf of employees include: wrongful termination, negotiation of employment contracts and severence agreements, sexual harassment, race harassment, age discrimination, retaliation, whistle-blowing claims, failure to pay wages and commissions, failure to reasonably accommodate disabilities or medical conditions and retaliation against physicians for advocating for medically appropriate health care. Where there is union protection, Robert works in conjunction with union representatives to ensure that all of the employees' rights are being protected. Robert has represented numerous professors, academic administrators, teachers and faculty.

Robert also represents clients with construction and real estate issues, which include payment disputes, mechanic's liens and stop notices, construction defects, delay and damage claims and boundary, landslide, and easement disputes between adjoining property owners.

Robert handles a variety of civil litigation including personal injury, elder abuse law, child abuse law, psychotherapy law, wrongful death and consumer class actions.

Education and Professional Activities

Robert obtained a B.A. in Finance in 1983 from the University of Illinois at Champaign-Urbana and his J.D. in 1986 from Marquette University Law School in Milwaukee, Wisconsin. He is admitted to practice law in Wisconsin and California in both state and federal courts. Robert is an active member of the Marin County Bar Association and the California Employment Lawyers Association (CELA). Robert has practiced law for 20 years with his older brother, Phillip Jaret.

Arthur Siegel obtained a B.A. degree from Miami University in Oxford, Ohio in 1973 and a Juris Doctorate from the University of San Francisco School of Law in 1976. After an internship at the EEOC's regional litigation center in San Francisco, Mr. Siegel was admitted to practice in 1976. In 1977, he was retained through the auspices of the ACLU to manage the litigation of numerous individual and class discrimination claims against the trucking industry, its trade organizations and union entities. In 1978, he started a private litigation practice in San Francisco specializing in employment matters. He also handled court trials, jury trials, arbitrations, administrative hearings, as well as severance negotiations for his clients. Mr. Siegel lectures to community and legal organizations in the areas of mediation and employment law. Since 1995, he has served as a mediator and neutral evaluator in employment disputes, both privately and for state and federal courts in the San Francisco Bay Area.

Robert N. Ives brings a wide variety of litigation and transactional experience to the firm through his Of Counsel affiliation. He concentrates in the areas of commercial, business and real property litigation and transactional matters, with specialized expertise in securities, insurance bad faith, wrongful termination and intellectual property litigation. He attended West Point, the U.S. Military Academy and the University of Hawaii during his undergraduate years before earning his law degree from Pepperdine University School of Law in Malibu, California in 1981.
