Mary Knapp-Samet, et al. v. Marin General Hospital Corporation; Sutter Health Corporation Case No. CIV 140-0998, California Superior Court, County of Marin.

On March 14, 2014, Jaret & Jaret, with co-counsel Arthur R. Siegel, filed a proposed Class Action Complaint against Marin General Hospital Corporation and Sutter Health Corporation on behalf of Mary Knapp-Samet, Jane Middleton, Kathryn Ballinger, Nora Burns, Barbara Russell, Winnie Huang, and Heather Gosliner for violations of California Labor Code, Wage Orders and the California Business and Professions Code by allegedly failing to properly pay overtime wages, failure to pay all wages upon separation of employment; failure to furnish and maintain timely and accurate wage statements, and in these ways engaged in unfair competition and also owe civil penalties to the extent that these other allegations also violated the Private Attorneys General Act of 2004 (“PAGA”). The Action was brought as a “putative” or “reputed” class-action lawsuit and sought damages, penalties, and restitution, as well as interest, attorney fees, and litigation costs.

After conducting discovery and investigation, the parties participated in two lengthy days of private mediation and after direct negotiations between Plaintiffs and Defendants they eventually reached an agreement to settle all the claims in the case for a total payment of $850,000 payable by Defendants as follows: $750,000 from Marin General Hospital and $100,000 from Sutter Health Corporation, including attorney’s fees and costs (subject to court approval). The class for settlement purposes is comprised of Nurse Case Managers working at Marin General Hospital between March 14, 2010 through March 22, 2016.

Because this is a class action settlement, the proposed settlement must be approved by the Court in order to be effective. On March 25, 2016, the Court signed an Order that preliminarily approved the proposed settlement, including approving the case to proceed as a class action for settlement purposes only. The Court approved a form of notice to be mailed to class members that informs them about the case and the proposed settlement.

On July 27, 2016, a motion for final approval of the settlement will be heard.
